What can we do for you?

Chambers UK - A Client's Guide to the Legal Profession states that "having developed expertise in the negotiation, pursuit and defence of personal injury claims, the firm has recently achieved a significant reputation in advising clients and their insurers following major disasters and representing them at subsequent public inquiries".

Our litigation services include the following:-

  1. Initial advice to you on contractual terms which you may subsequently wish to rely on in relation to, for example, enforcing your contractual rights, avoiding particular liabilities or dictating a particular dispute resolution mechanism. In our experience transactions correctly documented at the outset are less likely to result in litigation. We firmly hold to the view that dispute avoidance is better than dispute resolution!

    Disputes are an inevitable part of modern business. On many occasions resolution of these disputes will require external assistance. Our experienced team are here to help you resolve those disputes in a manner best suited to your needs.

  2. Advising you at the very earliest stages of any dispute with a view to identifying how that dispute may be resolved without the need for any form of expensive dispute resolution procedure. Our experience allows us to indicate to you the likely costs of proceeding with the dispute to a conclusion and to contrast that with the merits of early resolution.

  3. Negotiating a dispute on your behalf either with your opponent or those instructed on their behalf.

  4. Dealing with all forms of dispute resolution procedure if early negotiation is not possible. These services include, for example:-

    (a) Litigating in Scotland's Sheriff Courts. With offices in both Aberdeen and Edinburgh, we are particularly well placed to conduct litigation throughout Scotland on your behalf. We have among our staff experienced litigators and will only seek to employ specialist outside advocacy services on your behalf when we consider it to be in your best interests to do so. All our team are accustomed to conducting their own cases and do so on a regular basis.

    (b) Litigating in Scotland's Supreme Court, the Court of Session. We recognise that a number of cases are more appropriately dealt with in the Court of Session which is situated in Edinburgh. Our Edinburgh Office enables us to deal with all matters pertaining to dealing with cases in the Court of Session on your behalf.

    (c) Arbitrations and other forms of dispute resolution procedure. Our team is well versed in the different procedures which apply and can guide you through these various different mechanisms to secure the quickest and most cost effective result practicable.

On every level therefore we are here to deal with disputes on your behalf however those disputes arise and wherever those disputes are to be resolved.

The strength of our team allows us to advise across a wide area of subject matters including all forms of contractual dispute, construction issues, matters arising out of or in connection with intellectual property rights, property matters whether in relation to the purchase of property, lettings or perhaps land disputes, and lastly but by no means least all issues that arise out of accidents at work or elsewhere which are likely to or have led to personal injury claims.
