The law in relation to Health and Safety at Work is currently undergoing its biggest change since the Health and Safety at Work Act was introduced in 1974. The Government and Health and Safety Commission are pursuing a campaign of "revitalising Health and Safety". One of the major aims is to reduce Health and Safety failures by 30% by the end of this decade through increased regulation and measures aimed at securing compliance.
The Health and Safety Executive's new Enforcement Policy ( 2001) is far more prescriptive than before. In particular, Health and Safety Inspectors are now instructed to consider the role played by individual managers with a view to prosecuting individuals where appropriate. Tougher penalties for breaches , including imprisonment in some cases, are predicted. You need to be sure that your Safety Management System can cope with the increased demands that will be placed on it by new legislation and modern working practices.
Our specialist Health and Safety Team will provide advice on all aspects of the law in relation to Health and Safety at Work. We will review your safety management system and draw your attention to important changes which may affect your business. If an accident occurs we will provide specific immediate advice on how to deal with the aftermath including any investigation by the Health and Safety Executive or Police. We also provide an out of hours emergency service. Three of the lawyers in the Team have completed offshore survival training and medicals and can travel offshore.
